Summary/Abstract: Starting from the premise that decisions issued by the courts of appeal may be challenged when (the court), dismissing the appeal or admitting it only in part, has omitted by mistake to investigate one of the grounds for change or reversal, the article refers to the analysis of considerations for Decision No. 557/2014 of the Constitutional Court concerning dismissal of the plea of unconstitutionality regarding the provisions of art. 318 para. (1) last sentence of the Civil Procedure Code 1865.
