Summary/Abstract: Contemporary jurisprudence has shown an inconsistent trend as regards participation in the civil trial of certain special subjects, which require a different treatment, to the extent that legal disputes concern rights and/or obligations with patrimonial content. Thus, local councils and town halls were involved in this type of legal disputes without however anticipating or analysing their procedural capacity of use as regards their possibility to participate in such cases. Due to the arguments presented by this study, I reach the conclusion that local councils and town halls cannot participate in these matters as the law deprives them of the procedural capacity of use.
