Summary/Abstract: In managing public procurement the main principles of the law of public procurement should be used with particular emphasis on the rules of fair competition and equal treatment of contractors. The aim of the article is to examine and evaluate chosen activities of the contracting entity in the proceedings of the public procurement. The analysis has been conducted on the basis of data coming from the verdicts of National Appeals Chamber and reports of the Public Procurement Office for the years 2014-2015. Examples of verdicts prove that limitation of risks of unfair competition and non-equal treatment during the process of public procurement depends not only on procurers but also on contractors of public activities.
