Summary/Abstract: In this paper, the author analyzes the provisions of the new 2011 Civil Procedure Act on peaceful dispute resolution. In addition to the principle of peaceful dispute resolution which was proclaimed in the former legislative act, the new Act contains a brand new article which explicitly lays down this principle and introduces a compulsory attempt at peaceful dispute resolution between a claimant (a natural person or a legal entity) and a respondent (the Republic of Serbia, an autonomous province or a local self-government unit. The author analyzes the provisions of this Act in light of the applicable principles governing peaceful dispute resolution, with specific reference to the position of potential litigants and their mutual relations. Finally, the author explores the possibilities of enacting alternative legal solutions on this issue.
