Summary/Abstract: One of the most critical evolutionary moments of the international humanitarian law was that of accepting, as a fundamental principle, that force cannot be used unlimited (the right of belligerents to adopt means of injuring the enemy is not unlimited). That principle has set the limits on the use of force from which one can derogate only when the law specifically provides that. This paper identifies and presents the main legal provisions for the situations when force can be used within national military actions focusing on the rules of human rights law.
