Summary/Abstract: The paper aims at emphasizing the importance and impact of the new Code of civil procedure on the staying of proceedings by national court in Romania when it decides to make a preliminary reference to the European Court of Justice. Article 412(1) point 7 regulates for the first time this procedure and that is the reason the authors perform an examination of national case-law prior to this regulation, emphasizing certain comparative law issues and pointing out advantages and disadvantages concerning this regulation.
