Summary/Abstract: The preliminary ruling procedure is a means of judicial cooperation between the national court and the Court of Justice of the European Union (CJUE), provided for in article 267 TFUE. In this paper we will take into consideration the judicial phase of enforcement in which it is possible for the parties or even the courts itself to request/invoke a request for a preliminary ruling. We examine, in particular, in the context of denying the request for a preliminary ruling, pertinent examples from the Romanian case-law.
