Independent Regulatory Authorities in the Case Law of the Court of Justice of the European Union

Summary/Abstract: For regulatory authorities in some economic sectors the requirement of independence is prescribed by the EU law. In most cases, however, the EU law does not specify, what actions or to what extent shall be taken to implement the requirement of independence into the legal system of a Member State, while respecting the intentions of the European legislator. The article provides an overview of the decisions made by the CJEU, which provides guidance on how the requirement of independence should be interpreted by national legislatures.
