Summary/Abstract: Although designed to bring more rigour to the law courts, the procedure of verifying and regulating the court application in the civil process seems to be subject to a number of reservations, some of which contravene the essential principles of the civil process, including the presence of contradiction and the right to defence. This paper aims at examining the new solutions promoted in the article no. 200 of the Romanian Code of Civil Procedure, in the light of these principles and at proposing some solutions to lege ferenda.
