Summary/Abstract: Private enforcement actions in antitrust, even though there have been regulated for a long time in the Competition Act no. 21/1996, are still in shadow with respect to implementation. The parties, irrespective they are consumers as private individuals or companies, are reluctant when it comes to submitting to the national courts private enforcement actions for the damage occurred from an anticompetitive deed. Romania must transpose, by the end of 2016, the EU Directive for damages under national law for infringements of the competition law provisions, which will substantially amend the existing normative framework. The present article aims, at first, to present an overview of the private enforcement in the national law, and afterwards to outline the amendments brought by the Directive and the law that will transpose it internally.
