Theoretical and practical aspects relating to suspicious deaths of the persons detained in penitentiaries

Summary/Abstract: The criminal cases settled lately at the level of the Prosecutor's Office attached to Arad Court or that of prosecutor's office local units tackled, and generated different opinions, the issue of the competence to prosecute and the ”in rem” legal classification of suspicious deaths in penitentiaries. This issue became extremely important in the light of the recent ruling of the Constitutional Court of Romania, in the sense that eliminating the failure to observe the material competence rules from the framework of absolute nullity is unconstitutional.
