Summary/Abstract: Article notes the cause of emergence of public law. The comparative legal method is a platformthrough which you can get to know not only the cause of division but also the relationship betweenpublic and private law. Considerations are theoretical and point to the historical method of thedivision of public / private in France. The analyzed topics leads to the conclusion that the divisionlost its importance due to the approach of two parts also by the trend towards convergence by EUlaw. The result of synthesis is to find the reasons for adopting the way of development by publiclaw and the separation of its characteristics. The article contains an appeal mainly to the theoristsof French and Roman law.
