Summary/Abstract: The draft law on magistrate courts for petty offences of 1970 was created within the framework of codification works on petty offence law in the Polish People’s Republic The fact of sustaining the dependence of magistrate courts of local structures of Home Affairs administration was criticised during public discussion over the draft. Representatives of academics, who participated in the discussion, called for placing magistrate courts by local bodies of state administration or even transforming them into special courts. They postulated depriving the Minister for Home Affairs of the right to establish general principles for criminal policy and granting the Supreme Court with the judicial supervision over case-law magistrate courts. Those postulates served as the basis for the political system reform of 1990, which placed magistrate courts for petty offences in the structures of the Ministry of Justice.
