Summary/Abstract: This study is aimed to analyze the influence of legal provisions and contractual clauses on copyright. The articulation of copyright and matrimonial regimes is experiencing difficulties generated by the autonomy of the law: copyright is a branch of the private law, with object, methods and own principles, aimed to protect the author and the work, while the matrimonial regimes are circumscribed to family law, with object, methods and own principles, with the purpose of organizing the relations between spouses during marriage and to prevent on the patrimonial plan the situation of spouses in case of divorce.
