Summary/Abstract: The tort liability excludes de plano the contractual liability, but interferes often with other forms of legal liability, such as the criminal or contraventional liability, as well as with other forms of civil liability, such as the patrimonial liability. Most of the times there are problems in practice as to the effects arising from whether a tort is considered both a deed causing damage in terms of tort liability and an offence eventually leading to criminal liability. The aspects briefly clarified in this article refer to the relation between the two categories of liability from a practical perspective, as well as in the light of the new relevant legal provisions. Furthermore, the article aims to briefly shed a light on the many times incorrect terminology used in the matter of civil liability when one considers patrimonial and/or material liability.
