Summary/Abstract: This article approaches only contract obligations and, consequently, in terms of liability, only contract liability. Tort liability requires a distinct approach, so that we will not discuss herein the debtor’s solidarity in remedying the damage as a result of a tort leading to damage. In our private law, like in all obligations where several parties are involved, there are two types of joint obligations: joint obligations among creditors and joint obligations among debtors. Being consistent with the law, we will approach the two categories as distinct types, but we will start with the passive joint obligations, as they are of the most practical importance.
