Summary/Abstract: This article aims at determining the matter of tort liability in the Romanian private law, having as a starting point the new legal regulations, namely the new Romanian Civil Code. However, we will take into consideration the necessary comparisons with the former legal regulations on civil liability, as well as the essential elements of comparative law, namely the relevant concepts in the European codes, the French law, the Canadian law and the common law. In our view, such brief survey is necessary in order to eliminate the frequent confusions when approaching the judicial institution of civil liability, both among the elements of the two types of liability and between the former and a newly regulated field in the Romanian law, namely the precontractual liability.
