Summary/Abstract: Observation of spatial processes in Poland: progressing degradation of natural landscapes, processes of spontaneous urban sprawl, scattering buildings in rural areas, earmarking floodplains for development of housing, land degradation of scenic parks, all of which introduce disharmony in space, raises questions about the reasons for this state of a airs. The article, by analyzing selected legal aspects of spatial planning with their current interpretation used in administrative courts, points out the legal defects of the system which affect the spatial order and substantially increase costs of local spatial policy.
