Local referendum on the establishment, merger, division and abolition of municipalities and determining the borders of municipalities – selected aspects

Summary/Abstract: This article is intended to discuss selected legal aspects of the participation of citizens in the procedure of the establishment and changing the communes’ borders, particularly a legal regulation of the mechanism of holding a local referendum on the citizens’ initiative on the creation, connection, division and removing the commune and establishment of the commune’s borders. The author has exposed differences and the way of establishing relations between the institution of the local referendum on creation, connection, division and removal of the commune and establishing the commune’s borders and the institution of consultations with citizens. The subject of discussion were also procedural issues raising concerns and relating to the conduction of a subjected referendum, such as conditions of an efficient submitting a le on holding a referendum, the assessment of the led motion, the nature of results of this referendum, the way and catalogue of the entities in these results. Moreover, the most important arrangements which were made in this aspect by administrative courts, have been presented in this article.
