Summary/Abstract: The conduct of a person who, by means of words or gestures, threatens the physical integrity of a judge, prosecutor or criminal investigation officer has been incriminated by means of Government Emergency Ordinance no 198/ December 4th, 2008, as “defying the judicial bodies”. This new offence has been created due to the fact that the actions prejudicing the activity of the justice system, which affect the public image of the judicial bodies, have become more frequent. Considering the fact that there are opinions stating that defying the judicial bodies and the outrage should be viewed as different offences, it is necessary to make a parallel comparison between the two offences.
