Summary/Abstract: In the doctrine, probation is defined as a measure of social defense by depriving of liberty, in which the delinquent is treated in a free environment and the execution of the penalty is suspended conditionally. The measure does not have a retributive or punitive character and tends to ensure the protection of the society against the relapse, by placing the sentenced person in the most favorable conditions in order to prevent the relapse.
