Inability to purchase litigious rights of the persons participating in the application of justice

Summary/Abstract: It is about the inability of the persons participating in the application of justice to purchase litigious rights. Such a theme cannot be examined except in connection with the relevant procedural texts. In the hope that the oppositions being expressed at present as regards the enactment of the new Code of civil procedure shall be overruled, I will refer to the texts of this new code which, according to the law into force as at the drafting date of this text, shall become effective on the 1st of February 2013. Thus, I shall try to prove that these two new fundamental codes for the private law were conceived together and the offset effective for various judgments, of the dates when these codes become effective shall lead to incoherencies and uncertainties not serving to the purpose of the law: legal security.
