Legal and factual opinion on a D eputies’ bill amending the Act on the Implementation of particular Provisions of the European Union in the field(...)

Summary/Abstract: The amendment of the above mentioned Act results from the implementation of the provisions of five directives of the European Communities into the Polish legal order. Nevertheless, the author points out that the proposed amendment goes beyond the limits specified by EU law, reducing both the autonomy of private entities and constitutional freedom of contracts. He refers to the defective wording of the provisions specifying the substantive scope of the Act, at the same time supporting the proposal for the extension of the scope of claims that can be brought by persons harmed by unequal treatment and provisions modifying the rules for application of statute of limitation of claims.
