Summary/Abstract: The present text is the second part of an article published in SMIM in 2003. In the first part, we presented the evolution of the practice of legal guarantees during the 15th and 16th centuries, its emergence within the field of commercial relationships and its gradual transfer towards larger segments of social concerns. In the second part, we continue to describe the institution of the guarantees in the 17th century, while drawing a typology of it, in so far as the documentation allows us to do so. We consider that the use of the guarantees in the legal practice prepared the articulation of a more general system of legal procedures regulating the obligations. By the means of a correlation between the problem of guarantees and two other fields of social-legal research, namely those related to the phenomenon of tax evasion and to the problem of the control over criminality, we aim to shed light over larger topics concerning the social and political connections of the legal system. The institution of the legal guarantees appears, thus, as a revelator of the most general aspects of the problem of state building.
