Summary/Abstract: The public statements made by certain judges, that the situation of Romanian judges, who are thus judges of a State Party to the European Convention on Human Rights and a Member State of the European Union, who are the subject of public debate and measures to curtail certain of their economic rights, is similar to that of the Jewish population during the Holocaust, with Joseph Goebbels’ genocidal anti-Semitic propaganda and the requirement to wear the yellow star, which preceded the death camps and extermination, constitute serious acts of actively trivializing the Holocaust, prohibited by European Union Law and by purely domestic Romanian law. The failure of the Judicial Inspection and the High Council of the Judiciary to exercise their disciplinary powers, by refusing to take action and thereby encouraging the commission and spread of acts of active trivialization, is contrary to European and national legal rules and constitutes a form of passive trivialization of the Holocaust. The trivialization of the Holocaust, whether active or passive, constitutes a form of anti-Semitism that must be punished.
