Summary/Abstract: The data sharing agreement is a complex legal institute that is regulated at national and European level and combines elements of civil and public law. This complexity leads to difficulties in the interpretation of the applicable provisions and requires an in-depth analysis of the interests protected - private and public. Although the main purpose of the agreement is to protect the data subject, all issues related to its conclusion, performance, and the consequences of possible non-performance are governed by civil law.
