TRADE SECRETS IN THE CONTEXT OF DATA PROTECTION

Summary/Abstract: The GDPR recognises the right to the protection of personal data as a fundamental right, but one that is not absolute and must be balanced with other fundamental rights, including trade secrets and intellectual property rights, in accordance with the principle of proportionality. The purpose of this article is to explore this balance and analyse how the current case law of the Court of Justice of the European Union (CJEU) should be applied at national level.
