Summary/Abstract: Domestic violence is one of the most pressing problems in Bosnian and Herzegovina society, and the first form of defense against this type of violence is the imposition of protective measures, which enable the victim to leave the violent environment as easily as possible, i.e. to distance the perpetrator from themselves. Given the frequency of acts of domestic violence, the legislative authority has recognized the need to harmonize the current legal regulations concerning this topic with the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention), bearing in mind that it is the first legally binding instrument in Europe in this area that offers solutions aimed at zero tolerance for domestic violence. Given that the aforementioned Convention represents a major step forward in terms of legal protection against domestic violence, in this paper I will analyze the most significant provisions of the new Law on Protection against Domestic Violence and Violence against Women in the Federation of BiH that directly implement the Istanbul Convention, as well as an analysis of the most significant innovations in relation to the previous Law on Protection against Domestic Violence in the Federation of BiH, with reference to relevant case law.
