Summary/Abstract: Since 2020, the President of the Office of Competition and Consumer Protection (UOKiK) has been issuing decisions imposing fines on managers of undertakings that have entered into agreements restricting competition. The number of such fines is increasing year on year, and the institution itself plays a significant preventive and repressive role in the protection of competition in Poland. This makes it all the more important to analyse the decision-making practice of the President of UOKiK in detail, in order to answer the question of how the Polish competition authority reaches its conclusions regarding the imposition of fines on managers, particularly with regard to estimating the amount of the fine. The aim of this article is to present the results of an analysis of the decisions of the President of UOKiK regarding the imposition of fines on managers of undertakings that have breached the prohibition of entering into agreements restricting competition.
