Summary/Abstract: One of the most important subjective rights in the field of health care is the right of access to medical care, since without its guarantee it is impossible to ensure the highest attainable standard of physical and mental health of every person. The key place of the indicated right has been recognized for decades in a number of legal acts, adopted by the European Union and the member states. Through these legal instruments, specific measures and mechanisms have been introduced, aimed at achieving adequate conditions for the realization of the right of access to medical assistance, in compliance with European values for the protection of human rights and non-discrimination. Of interest is the regulatory framework in the European Union, adopted as a result of the actions and policies of the European authorities and institutions, which has contributed to the achievement of equal access to medical care within the European Union.
