Summary/Abstract: This paper analyzes the regulation of Artificial Intelligence in the medical field, its center of gravity being the legal responsibility in the context of automatic errors. The research focuses on the evolution of the European and international legislative framework, highlighting the existing gaps in the rules of civil and criminal liability. In this context, a reassessment of traditional principles of accountability is proposed, given the autonomous and opaque nature of AI systems. The article argues the need to adopt flexible and adapted regulations, mentioning the importance of collaboration between legislative actors and legal practitioners to ensure an efficient legal framework that supports innovation in medicine, while protecting patients' rights.
