Note Concerning the Actions Undertaken by the Marshal of the Sejm in the Procedure for the Election of a Judge of the Constitutional Tribunal

Summary/Abstract: This analysis concerns the nature of the powers vested in the Marshal of the Sejm of the Republic of Poland with respect to the Sejm’s procedure for the election of a judge of the Constitutional Tribunal. The analysis outlines the avenues through which the Marshal of the Sejm may influence the work of the Sejm committee issuing opinions on candidates proposed for election to the office of a judge of the Constitutional Tribunal. This note also addresses the legal liability of the Marshal of the Sejm for failure to fill a judicial vacancy at the Constitutional Tribunal within the prescribed time.
