On Constitutionality of the Resolution of the Sejm of 7th December 2023 on Appointment of the so-called Commission to Investigate the Postal Elections

Summary/Abstract: The Sejm’s position regarding the application of a group of Deputies to examine certain provisionsof the resolution provides that Article 2 of the resolution, which defines the scope of the Sejm’sinvestigation entrusted to the designated investigative committee, conforms to the Constitution.According to the applicants, neither the standard conduct of a presidential election nor the typicaladministrative activities and lawful measures undertaken in the course of such an election may besubject to investigation by a parliamentary committee of inquiry. In the author’s opinion, this viewlacks a convincing justification in light of Article 111 para.1 of the Constitution and significantly nar‑rows the concept of a “matter” that can be addressed by a parliamentary committee of inquiry, thusconstituting an excessive restriction on the Sejm’s oversight powers.
