On Constitutionality of the Resolution of the Sejm of 19th December 2023 on Appointment of the so-called Visa Investigative Committee

Summary/Abstract: The Sejm’s position regarding the application of a group of Deputies to examine certain provisionsof the resolution provides that Article 2 of the resolution, which defines the scope of the Sejm’sinvestigation entrusted to the designated investigative committee, conforms to the Constitution.According to the applicants, the Sejm should not appoint an investigative committee to investi‑gate a specific case as long as other state bodies responsible for prosecuting crimes conduct theirproceedings to the same or similar extent. In the author’s opinion, it is not justified to make thefunctioning of the investigative committee dependent on the actions taken by other state bodiesunder separate legal procedures. The Sejm’s investigation has autonomous objectives and effects,which do not exclude a parallel investigation of the case in the paradigm of repressive proceedings.
