Summary/Abstract: The problems arising from the transformations proliferating in the heat of digitalization have led to the debate surrounding the future of labour relations, although there are numerous doctrinal exponents who draw important parallels and similarities between this revolution and the industrial revolution, warning that predictions about the massive destruction of jobs, the replacement of workers by the implementation of artificial intelligence systems and the end of Labor Law are not at all new. Digitalization has significant repercussions on the power imbalance underlying the employment relationship. Information and communication technologies have intensified the powers of business management and control to unsuspected limits, all under the pretext of growth and productive efficiency. The above is not the only consequence to consider, since new forms of productive organization also have repercussions on the organization of work. Productive decentralization, fragmentation and atomization of new business forms lead to precarity and weakening of job security as the main means of integration in the employment relationship. All of this leads to a fragmentation of the employment contract typology and promotes a phenomenon of weakening of job categories. In the face of these phenomena, workers' rights to participate, as an expression of democracy in the workplace, must be strengthened in order to level the inequalities that the pervasiveness of digitalization is unleashing in the company. Regulatory initiatives for digitalization must necessarily include collective intervention regarding the powers of the employer in organizing the provision of the service.
