Summary/Abstract: On the fortieth anniversary of the promulgation of the Workers' Statute, calibrate the dimensions of the workers' assembly and its impregnation in the evolution of the social model can mean a challenge that serves to reflect on its current legal order and the operability and functionality of an important instrument of direct participation of workers. The historical trajectory of this institution shows its different metamorphoses driven by the political signs existing at all times. Without going through too remote times, the workers' assembly has become the embryo from which democratic unionism resurfaces. The postponement of freedom of association, the criminalization of the right to strike and the distortion of collective bargaining have marked asociety in which freedom and democracy were notable for their absence. Constitutionally contemplated, the right of assembly constitutes a power without which the constitutional list of public rights and freedoms would remain unfinished and unequal since it represents one of the most effective tools for the achievement of a pluralistic and democratic society.
