Summary/Abstract: This study aims to investigate the conceptual definition and legal treatment of an important form of service provision, which is remote work and telework. As we will have the opportunity to highlight, teleworking has taken on special significance with the paradigm shift imposed by the health crisis caused by COVID-19. During the pandemic period, teleworking has come to play a relevant role fundamentally because through this type of service provision, the necessary social distancing could be achieved to avoid massive contagion and, at the same time, it has served to avoid massive destruction of jobs. In this sense, this study aims to address the existing convergences and divergences in the legal treatment of distance work and telework in two important countries of the European Union: Romania and Spain. This analysis will allow us to conclude the existing similarities between the two legal systems under discussion. With the aforementioned purpose, issues such as the necessary voluntary nature of this provision of services, equal treatment and opportunities between face-to-face workers and teleworkers, safety and health, collective rights and many other aspects will be addressed.
