10. The letter of guarantee for participation issued by a foreign company in Romanian. Request for clarifications

Summary/Abstract: The opinion of the contracting authority according to which the letter of guarantee, being issued by a foreign company, had to be compulsorily submitted into the respective foreign language, cannot be held. However, in this case, the contracting authority was entitled to request clarifications, since the above-mentioned letter of guarantee, drafted into Romanian, includes a number of disagreements, its back being characterized by a series of gaps and unclear phrases from the perspective of the Romanian language.
