Considerations about the right to defense in the new civil procedure Code

Summary/Abstract: The right to defense is provided in all national and international procedural regulations, the most relevant at international level being the European Convention of Human Rights and at national level the new civil procedure Code. In the first part, the study presents all the forms and modalities which express the content of the right to defense in the civil trial, the most important being the possibility to benefit from a specialist services. The second part of the study is dedicated to the analyses of the compulsory lawyer or legal advisor assistance before the court and for the drafting of the appeal petition.
