Summary/Abstract: If the debtor does not voluntarily performs the obligation, the creditor can always ask the debtor to be compelled to perform the obligation in kind, unless such execution is impossible. Enforcement in kind does not exclude the debtor obligation to pay damages to the lender, when the latter suffered an injury caused by the failure or improper enforcement, without justification, by the delayed debtor of the obligation.
