Summary/Abstract: This study aims to discuss certain particularities that characterize disputes arising from the exercise of a public function, as compared to other categories of litigation. These are analyzed in light of the provisions of Law No. 554/2004 on administrative litigation, of other normative acts that refer disputes arising from their application to the administrative courts, as well as of the case law of the judicial courts, with particular emphasis on the binding jurisprudence of the High Court of Cassation and Justice and of the Constitutional Court. The central issue concerns the territorial jurisdiction of the court when civil servants are represented by a trade union. The solution we propose is that jurisdiction should lie with the court having territorial competence at the registered office of the claimant trade union.
