Approach on the legal nature of employment relationships of civil servants

Summary/Abstract: The study hereby represents a viewpoint as regards the stand expressed in professional doctrine on the legal nature of employment relationship of civil servant. Labor law doctrine, by its representatives, expresses the view according to which employment relationship of civil servant would stand for a legal labor relationship, as well, thus entering the labor law category. We wish to establish, on grounds of substantive evidence, that the employment relationship of civil servant has a distinct identity, conferred by the exercise of public power prerogatives, and that it constitutes a subject of public law. The study hereby is indicative of the continuing dispute perspective between labor law doctrine and administrative law doctrine on the legal status of civil servant.
