Legal Opinion on the Legal Significance of the Supreme Court’s Resolution Confirming the Validity of the Election of the President of the Republic of Poland

Summary/Abstract: This analysis examines the legal nature and consequences of the Supreme Court’s resolution confirming the validity of the election of the President of the Republic of Poland. The opinion addresses the issue of the timeframe within which the Supreme Court must adopt the resolution and the legal implications of its failure to do so before the expiry of the outgoing President’s term of office. The analysis concludes that the Supreme Court’s resolution constitutes a mandatory stage of the electoral procedure and, at the same time, a necessary precondition for the President of the Republic of Poland to assume office. The resolution should be published in the Journal of Laws (Dziennik Ustaw).
