Summary/Abstract: When on October 8, 2021, the United Nations Human Rights Council issued resolution no. 48/13, proclaiming the human right to a clean, healthy and sustainable environment, this event was described as a breakthrough act for contemporary international law. It was expected to achieve at least the same success as Resolution no. 15/9 on the human right to water and sanitation. However, an in-depth comparative analysis of both acts from the perspective of their effectiveness in international law leads to different conclusions. Resolution no. 48/13, although it does bring the international community closer to the customary human right to the environment, has a number of shortcomings that may lengthen the path to this goal.
