Summary/Abstract: Disciplinary liability is an important legal institution of labor law. Both Framework Law no. 53/2003 (Labor Code)1 and other special normative acts (eg. Law 188/1999on the Civil Servants' Statute2) pay due attention (by separate legal norms) to this form of liability. Employee quality (of an employee or civil servant, etc.) implies a number of obligations, including the observance of the labor discipline3. Disciplinary liability – a form of legal liability – occurs when the employee commits a disciplinary offense, that is to say, an unlawful act consisting of failure to observe his / her duties, violation of order and discipline at the workplace4.
