Summary/Abstract: Since its entering into force, the current Criminal Code has been subject to continuous revision, with practitioners being particularly interested in making certain amendments in order to correct certain shortcomings or to fill certain gaps. In order to achieve the aforementioned, it has often been necessary for the Romanian Constitutional Court to intervene, which, through its decisions, has succeeded in ensuring a balance in the criminal legal system in our country. Despite the fact that the crime of deception implies an incriminating text that does not entail great difficulties of interpretation, due to the numerous practical cases under which it can be encountered, different perspectives have emerged that have supported a rethinking of the text of the law, so that it corresponds to certain standards in the matter. The social and other consequences of committing an act of deception are very complex, so that understanding the incriminating text requires an extensive process of study in order to ensure an effective application of the legal provisions. The constitutional court's corrections appear to be not only mandatory, but also necessary, as they prevent misapplication of the legal rules in the future, manifested by different solutions in similar cases. In such cases where the decisions of the Constitutional Court do not uphold the submitted complaints, the subject of the complaint will often form a subject for specialized criticism.
