Summary/Abstract: Over the last decades, cyberspace has had a significant impact on all aspects of human society. The progress of mankind and the activities of modern society, including the protection of fundamental rights, economic and social interactions, depend now more and more on communication infrastructures and information technologies. Open cyberspace has facilitated global social and political relations, breaking down barriers between nations, citizens and ethnic groups, enabling the exchange of information and ideas on a global scale. This is achieved through forums dedicated to freedom of expression and respect for fundamental human rights. The values, principles and rules promoted and upheld by the European community must also be applied online, so that cyberspace remains a free and accessible place. Online freedom requires security and protection. The Internet must be protected from malicious activities, abuses and incidents. In order to achieve these goals, governments play a key role in ensuring a free and secure cyberspace. In addition, governments have a responsibility to protect access and respect fundamental rights online, to maintain reliability and interoperability of the internet. However, the private sector controls and operates much of cyberspace, which means that any initiative must recognize the essential role of the state in ensuring cybersecurity, even if this role is limited to creating an appropriate legislative framework for doing business in this kind of environment.
