Romanian Legislation and International Regulations on Bullying, Cyberbullying and Mobbing

Summary/Abstract: The research aimed to present a parallel between the types of harassment of bullying, cyberbullying and mobbing, with similarities and differences, with an emphasis on Romanian legislation and international regulations in the field, analyzing legislative limitations, as well as ferenda law proposals. Bullying is found predominantly in the school environment, mobbing mainly in the organizational environment, and cyberbullying is the most versatile, being present anywhere and anytime. In Romania, the legislation included psychological violence - bullying in the National Education Law, but without providing for sanctions related to it, cyberbullying is provided for in the law only as a component of domestic violence, and mobbing is perhaps best framed in the national legislation. International regulations make general, non-specific references to these forms of harassment. In this context, some legislative improvements are required, including laws that include a sanction, and that cyberbullying be sanctioned by a specific and clear law.
