Is the right to the protection of personal data a constitutional barrier to exploitation?

Summary/Abstract: The use of personal and health data is becoming increasingly central. The European Union has also adopted a European Data Strategy to make the most of the positive effects of data. In this context, several legislative steps and initiatives have already been taken, including the Data Governance Regulation and the draft Data Sharing Act and European Health Data Space Regulation. While EU legislation is clearly moving towards expanding the possibilities for commercial and non-commercial use of personal and health data, there is also a question of a fundamental constitutional right. Can a civil law contract limit the protection of personal data that can be traced back to human dignity? Does the right of informational self-determination of the person concerned extend to this type of decision? In this paper I seek to answer these questions.
