CRIMINAL-LEGAL ANALYSIS OF SOME OFFENCES SIMILAR TO DESERTATION PROVIDED BY THE CRIMINAL CODE OF THE REPUBLIC OF MOLDOVA

Summary/Abstract: Desertion is not the only military crime that attacks the relations established during the period of ensuring the security of the state through the defense system, but it also includes a number of related acts that also undermine the capacity of the public authorities responsible for the defense of the country to function efficiently. Moreover, according to the criminal legislation of the Republic of Moldova, similar crimes, based on their harmful effect, include a number of other criminal acts such as: evasion from military service (art. 372 of the Criminal Code); violation of the rules regarding the alert (combat) service of military troops (art. 375 of the Criminal Code); violation of the statutory rules regarding internal service (art. 376 of the Criminal Code); wilful abandonment of the battlefield or refusal to act with a weapon (art. 386 of the Criminal Code). For a good understanding of the particularity of desertion in the context of the multitude of similar criminal acts, in this article we will examine, in great detail, all the crimes that violate the order of military service and other obligations related to the defense of the homeland.
